Kepsake Terms of Service

1. Who we are

Kepsake is a service operated by Volodymyr Viktorovych Kovalchuk, an individual entrepreneur (ФОП) registered in Ukraine, based in Dnipro, Ukraine ("we", "us", "Kepsake"). These Terms govern your use of kepsake.com (the "Service").

2. Your account

You need to register to use the Service. You're responsible for keeping your account credentials secure and for all activity under your account. The Service is intended for people 18 or older, or younger users with a parent or guardian's permission.

3. Content you upload

You keep all rights to the photos you upload. By uploading photos, you grant Kepsake a limited license to store, process (including AI processing for album curation — see the Privacy Policy), and display that content solely to provide the Service to you, in line with the privacy level you choose for each album.

You may not upload content you don't have the rights to, or any unlawful content, including any content depicting child sexual abuse — such accounts are blocked without notice and reported to the relevant authorities.

4. Album privacy

Each album has a privacy level you choose yourself: private, link-only, or public. You're responsible for who you share the link with, or what you make public.

5. Plans and billing

Free plan: 1 album, unlimited photos within it, AI curation, private or public sharing.

Premium plan ($5/month): everything in Free, plus unlimited albums and all available album widgets.

Premium payments are processed by Paddle.com Market Ltd. as the Merchant of Record — Paddle is the seller of record for payment transactions, issues invoices, and handles applicable taxes. Subscriptions renew automatically each month until cancelled. You can cancel anytime in account settings — Premium access continues until the end of the paid period. Refund terms are covered separately in the Refund Policy.

We may change plan pricing, giving existing Premium subscribers at least 30 days' notice.

6. Service availability

The Service is provided "as is." We don't guarantee uninterrupted availability and may temporarily suspend access for maintenance.

7. Limitation of liability

To the extent permitted by law, Kepsake isn't liable for indirect damages, data loss, or lost profits arising from use of the Service. Our total liability is capped at the amount you paid for the Service in the preceding 12 months.

8. Termination

We may suspend or close your account if you breach these Terms. You can delete your account yourself at any time.

9. Changes to these Terms

We may update these Terms. We'll post material changes on the site or notify you by email at least 14 days before they take effect.

10. Governing law

These Terms are governed by the laws of Ukraine. If you're a consumer based in a country (such as an EU member state) whose law gives you mandatory consumer-protection rights that can't be limited by contract, this section doesn't take those rights away — you keep them regardless of this governing-law choice.
